TERMS AND CONDITIONS OF USE

These are the Terms and Conditions for ManifestHER, located in Oakville, Ontario, Canada. In these terms, "ManifestHER," "we," "our," and "us" mean ManifestHER, and "you" and "your" mean anyone who visits our website, buys a ticket, registers for, becomes a partner of, or attends a ManifestHER event. "Event" means any ManifestHER event, including VIP Days, retreats, and gatherings, along with the related communications and materials. "Partner" means any person or business that purchases or applies for a partnership with an Event.

Please read these terms carefully before buying a ticket or partnership. By checking the acceptance box at checkout, purchasing a ticket or partnership, registering, or attending an Event, you agree to them.

GENERAL

This website and our Events are owned and operated by Renée Walker and Binu Dhindsa, carrying on business as ManifestHER. You must be at least 18 years old (or the age of majority where you live) to buy a ticket or partnership. We may update these terms from time to time, and the "last updated" date above will show the most recent version. The terms in place when you make your purchase are the ones that apply to that purchase.

ACCESSIBILITY

We want our Events to be welcoming to everyone. If you need an accommodation to take part comfortably, please email [email protected] as early as you can, and we will do our best to help.

TICKETS AND PAYMENT

Prices are shown in Canadian dollars (CAD) at checkout, and applicable taxes, such as HST, are added or included as shown. By completing your purchase, you authorize us to charge your chosen payment method for the total shown. Payments are handled by third-party payment processors, and we do not store your full card details. Please provide accurate payment information so we can complete your order.

Full payment is required to secure your ticket or partnership unless we have agreed otherwise in writing. Your ticket or partnership is not confirmed until we receive your payment.

We may change our prices for new purchases at any time. We cannot adjust the price of a ticket or partnership after it has been purchased. If we make a pricing error, we will email you to let you know and give you the chance to decide how you would like to proceed.

NO REFUNDS

All ticket and partnership sales are final. Tickets and partnerships are not refundable, including if you are unable to attend or take part. The only exceptions are the ones described under "Partnerships" and "If We Cancel or Reschedule" below.

TRANSFERRING YOUR TICKET

Your ticket is transferable. If you cannot attend, you are welcome to pass it to someone else. To transfer your ticket, please email [email protected] at least 48 hours before the Event with the new attendee's full name and email address. We will update our records and confirm the change with you. Tickets may not be resold for more than the price you paid. Transfers requested less than 48 hours before the Event may not be possible.

PARTNERSHIPS

These terms apply to every ManifestHER partnership. The partnership levels, pricing, and benefits are described on the relevant partner page at the time you purchase, and that description forms part of your agreement with us.

Partnership fees are non-refundable. This includes situations where you change your plans, are unable to take part in the Event, or do not provide your materials in time. The only exceptions are the ones described below and under "If We Cancel or Reschedule" below.

In rare and exceptional situations, such as a serious medical emergency or a death in the immediate family, we may, at our sole discretion, consider a partial refund after deducting any non-recoverable costs already incurred. This is not guaranteed and is decided case by case.

If you are unable to take part, you may ask to transfer your partnership to another business or individual. Transfers need our written approval and must fit the values and audience of ManifestHER. Sub-leasing, reselling, or sharing a partnership without our approval is not permitted.

Partners are responsible for sending their logo, copy, and any other materials by the deadlines we share, and for making sure they have the right to use everything they send us. If materials arrive late, some benefits may be reduced or unavailable, and no refund will be given. We may make reasonable adjustments to the placement, format, or timing of partner benefits.

By becoming a Partner, you allow ManifestHER to use your name, logo, and the materials you provide to promote the Event, on our website, social media, email, and at the Event. You may use ManifestHER's name and branding only with our written permission.

Partners are responsible for their own products, services, and claims. ManifestHER does not endorse or guarantee any Partner's offerings or results, and Partners agree to follow all laws that apply to them.

ManifestHER does not guarantee any number of attendees, leads, sales, or other business results from your partnership.

Partners agree to protect ManifestHER, its co-owners, and its team from claims, losses, and costs that arise from the Partner's products, services, materials, or marketing claims, to the extent permitted by law. Partners are responsible for any licences, permits, and insurance needed for what they offer or sell at the Event.

Partners are expected to act professionally and respectfully toward guests, other Partners, and our team. We may remove any Partner whose conduct is disruptive, disrespectful, or harmful to the Event or other participants, and no refund will be given.

Experience Partner arrangements are set up through an inquiry. If we confirm different terms with you in writing, those written terms apply to your partnership where they differ from this section.

IF WE CANCEL OR RESCHEDULE

If ManifestHER cancels an Event, you will receive a full refund of your ticket or partnership price. This applies for any reason, including reasons outside our control, such as severe weather, venue closure, illness, government restrictions, or an emergency. If you prefer, you may choose a credit toward a future ManifestHER Event instead of a refund.

If we reschedule an Event, your ticket or partnership will automatically carry over to the new date. If you cannot attend on the new date, email us within 14 days of the announcement and we will refund your ticket price. Partnership payments carry over to the new date and are not refundable.

We may need to make changes to the date, schedule, format, speakers, facilitators, or venue, including for reasons outside our control. We will do our best to let you know in advance and to keep the experience as close to what was promised as we can.

If an Event is cancelled or changed, we are not responsible for travel, accommodation, or other costs you may have paid in connection with attending or taking part.

PHOTOS AND VIDEO

We may take photos and video at our Events. By attending, you consent to ManifestHER photographing and recording the Event and using those images and recordings, including ones that show you, for marketing and promotion, such as on our website, social media, and email. We will not pay for or credit this use. If you would prefer not to be photographed or filmed, please let our team know at check-in and we will do our best to respect that.

ATTENDEE CONDUCT

We want every guest to feel safe, welcome, and supported. We may ask anyone whose conduct is disruptive, disrespectful, unsafe, or harmful to the Event or other participants to leave, and no refund will be given if that happens. You agree to follow the venue's rules and any reasonable instructions from our team.

WELLNESS AND EDUCATIONAL DISCLAIMER

Our Events and materials are for education, inspiration, and personal growth only. They are not medical, mental health, legal, financial, or other professional advice, and they are not a substitute for care from a qualified professional. If you have questions about your health or circumstances, please speak with an appropriate professional. You are responsible for your own wellbeing and for any choices you make before, during, and after an Event. We cannot promise any particular result, and individual experiences will vary.

INTELLECTUAL PROPERTY

All content connected to ManifestHER, including text, images, designs, graphics, logos, names, videos, handouts, and presentations, belongs to ManifestHER or the person who has permitted us to use it. Please do not copy, republish, record, sell, or share our content or Event sessions without our written permission. If you would like to use any of our content, email us at [email protected] first.

LIMITATION OF LIABILITY

You attend our Events at your own risk. To the fullest extent permitted by law, ManifestHER, its co-owners, team members, speakers, and partners are not liable for any loss, injury, damage, or cost arising from your attendance at an Event or your use of our website or materials, except where the law does not allow us to limit liability. You agree to hold ManifestHER, its co-owners, team members, speakers, and partners harmless from claims arising from your participation, to the extent permitted by law.

Our website and materials are provided "as is." We try to keep our information accurate and up to date, but we cannot guarantee that it is complete or error-free. If you spot a mistake, please let us know.

PRIVACY

DISPUTES

If a concern comes up, please contact us first at [email protected]. We will work with you in good faith to find a fair resolution. If we cannot resolve it together, we both agree to try mediation before starting any court action.

GOVERNING LAW

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute that cannot be resolved will be handled by the courts of Ontario.

ENTIRE AGREEMENT AND SEVERABILITY

These terms, together with our Privacy Policy, the partner page and details of what you purchased, any partner form you sign, and any written agreement we make with you, are the full agreement between you and ManifestHER about your use of our website and Events. If these documents differ, a written agreement we make with you comes first, then the partner page, then these terms. If any part of these terms is found to be unenforceable, the rest will continue to apply.
